Copyright Compliance Policy

This is the official copyright compliance policy ("Copyright Compliance Policy") for wiki-teacher.com ("Site"), an Internet website offered by the Clark County School District ("CCSD"). We take protection of copyrights very seriously and employ multiple measures to prevent copyright infringement on this Site and to promptly end any infringement that might occur. This Copyright Compliance Policy sets forth the procedures undertaken by Wiki-Teacher and CCSD to respond to notices of alleged copyright infringement from copyright owners and to terminate the accounts of repeat infringers, and does not cover any other procedures of the Site or CCSD.

This Copyright Compliance Policy is a part of the Terms & Agreements of Wiki-Teacher.com. Any capitalized terms that are not defined in this Copyright Compliance Policy shall have the meaning given in the Terms & Agreements. Both the Terms & Agreements of Wiki-Teacher.com and this Copyright Compliance Policy are legally binding on all Users.

How to Send a Notice of Copyright Infringement

If you are a copyright owner (or the owner's authorized agent) and have a good-faith belief that any content on this Site is infringing on your copyrights, you may notify us using this procedure. In order for us to process your notice of copyright infringement, written communication must be sent to the agent designated ("Designated Agent") below and must include the information specified below. When we receive a notice under this procedure, we will expeditiously remove or disable access to the material that is claimed to be infringing or to be the subject of infringing activity.

How to Send a Counter-Notification

If we receive a notice of copyright infringement sent to our Designated Agent with the information described above, we will expeditiously remove or block access to the Site Content that is claimed to be infringing. We will also send notification about these actions to the User who posted the Site Content at the email provided by the User in conjunction with their account with the Site.

If you are a User who posted Site Content that was removed in response to a notice of copyright infringement and you believe that the material was removed due to misidentification or mistake, you may request that we restore the Site Content or cease blocking access to the Site Content by sending us a written communication to our Designated Agent for receiving notices of infringement (see the contact information above). This counter notice must include substantially the following information:

When we receive a counter notice that complies with these requirements, we reserve the right, but not the obligation, to restore the Site Content that was removed or to allow access to the Site Content after forwarding a copy of the counter notice to the person who sent the notice of infringement and waiting at least 10 business days. If, during those 10 business days, the person who sent the original notice of infringement notifies us that such person has instituted a suit to seek a court order to restrain the User from infringing activity relating to the material on the Site, we will not replace the material. Otherwise, we may re-post the material at our discretion. However, pursuant to the Terms & Agreements of Wiki-Teacher.com, we reserve the right to remove any Site Content at any time for any reason. A User who sends a counter notice pursuant to this Copyright Compliance Policy expressly acknowledges and agrees that we shall not be liable to the User under any circumstances for declining to replace or restore material.

Repeat Infringer Policy

We will terminate the privileges, account, and membership of any repeat infringers. A repeat infringer is any User who has contributed Site Content two or more times for which we receive a notice of infringement under this Copyright Compliance Policy. Each User agrees that if their account is terminated pursuant to this Copyright Compliance Policy, the User shall not attempt to establish a new account on the Site under any other name, real or assumed, and further agrees that if the User violates this restriction by opening a new account after being terminated pursuant to this Copyright Compliance Policy, the User shall indemnify and hold harmless the Site and CCSD from and against any and all liabilities that we may incur as a result thereof.

This document, which is a part of the Terms & Agreements of Wiki-Teacher.com, is the sole statement of the Copyright Compliance Policy with respect to the Site.
